ARTICLE 1 – Object
These Terms and Conditions outline the rules and regulations for the use of Porte-Bonheur’s website, accessible at https://porte-bonheur.mu.
By accessing this website, you agree to be bound by the following Terms and Conditions. In case you do not accept to be bound by these Terms & Conditions, you may not use this website including any services provided hereunder.
“We“, “Our” and “Us” refers to Porte-Bonheur.
“Customer“, “You” and “Your” refers to you, the person log on this website and compliant to these Terms and Conditions.
The validation click that you perform during the checkout process on this website constitutes an order confirmation and constitutes your irrevocable acceptance of these Terms and Conditions.
By accepting these Terms and Conditions, you expressly declare that you are of legal age – eighteen (18) years or older – and has the legal capacity to place an order on this website.
ARTICLE 2 – Website
https://porte-bonheur.mu is a website edited and operated by the Porte-Bonheur Online Trading, whose head office is located at Royal Road Saint-Pierre – Moka – Mauritius
This website is normally accessible to users at any time (24 hours a day, 7 days a week), except in the event beyond of our control or any breakdowns and maintenance interventions necessary for the proper functioning of the website.
ARTICLE 3 – Registration
Customers are free to browse the website without registration, but registration is mandatory for the customer to be able to:
- Open an account;
- Place an order;
- Receive newsletters with exclusive online offers.
Customers will need to provide the following details to process their registration:
- Phone Number;
- A valid e-mail address (this e-mail address will be used for identification purposes and for sending notifications and electronic receipt);
- A valid address.
During registration, the Customer will be asked to choose a login name and a password to access his account. The email address will be used as login name.
ARTICLE 4 – Products
The products for sale on this website are new products and the prices are valid as long as they are visible and while stocks last. Porte-Bonheur agrees to use all reasonable means to display the actual availability of products on the website, but cannot be held responsible for the possible unavailability of an ordered product. The Customer will be able to view the different products by browsing the different categories and will be able to sort the products with a filter system (variables depending on the categories).
The Customer who ordered a product out of stock will be able to modify or cancel his order, in which case he will be refunded the amount received by Porte-Bonheur. In the event of prolonged unavailability (more than 1 month), the order will be automatically canceled. Reimbursement will be made with the same method of payment as for the order, except with the Customer’s agreement for another reimbursement method, within the limits of the payment methods available on this website.
ARTICLE 5 – Order
The Customer places his order according to the checkout process on this website. After selecting the product(s), the Customer must complete all the mandatory fields specified on the form made available to him for creating an account. The Customer is required to provide all the information necessary for invoicing and/or delivery and is responsible for the accuracy of the latter.
Porte-Bonheur cannot be held responsible for the consequences related to the communication of incorrect information provided by the Customer when ordering or registering on the website. All costs related to the reshipment or the organization of a new delivery of the products due to an entry error by the Customer will be the sole responsibility of the Customer.
During the checkout process, the Customer chooses one of the payment methods offered and will follow the instructions on the website. Porte-Bonheur will deliver the ordered items only in the event of full payment.
The Customer will receive an email confirming the order and its payment, with a summary of the order and can track their order via their personal “Order” page.
In addition, Porte-Bonheur reserves the right to refuse any order from a Customer with whom an ongoing dispute exists or if the latter has not settled an order in progress.
ARTICLE 6 – Receipt
A confirmation including a receipt of the transaction will be sent to the Customer’s e-mail account upon successful online payment for Products & Services purchased. The Customer can view order history of his account at all times by logging into “Order” page. If the confirmation email was not received following the validation of an order (technical reasons, spam directories, etc.), it is the Customer’s responsibility to contact Customer Service. The information recorded by our system is considered as proof of the order (content and date) by the Customer.
ARTICLE 7 – Price
The prices displayed on this website are in Mauritian Rupees (Rs) all VAT included and excluding delivery costs which are the responsibility of the Customer and which vary according to the weight of the order. The shipping costs applicable to the Customer’s order are communicated during the checkout process.
Porte-Bonheur reserves the right to modify its prices at any time. However, the products will be invoiced on the basis of the rates in effect at the time of order entry, subject to availability.
ARTICLE 8 – Payment
The Customer can choose from the following payment methods at the moment of placing an online order:
- MCB Juice;
- Cash-On-Delivery (in that case, the Customer must be able to pay the exact order amount when the order is delivered. Checks are not accepted, and the courier cannot provide change).
We also inform our Customers that we do not keep data related to bank cards following payment. Confidential data is directly encrypted and transmitted to the payment server, without passing through our server.
ARTICLE 9 – Delivery
The service of Porte-Bonheur is reserved for Customers with a delivery address in Mauritius.
The products are delivered to the delivery address that the Customer has indicated during the checkout process. The Customer therefore undertakes to provide, when ordering, all the information necessary in order to guarantee a successful delivery. In the event that the information is incomplete or erroneous, Porte-Bonheur cannot be held responsible for the failure of the delivery. In the event of additional costs, they will be charged to the Customer.
Handling charges are fixed, while shipping charges vary depending on the weight and total volume of the shipment. We recommend that you consolidate your purchases into one order.
All orders placed on this website are dispatched within 48 hours. If the item ordered is available in stock, the delivery time is within five (5) working days between the time you order and the time you receive your package. In the event of absence during a delivery, the Customer has fifteen (15) days to collect the package from the date of the delivery notice.
In case of out of stock, the delivery time is approximately 1 month, depending on product availability. For more information on product availability, please contact Customer Service.
Delivery times are given for information only. Porte-Bonheur cannot be blamed and held responsible for the consequences of any event beyond his control, due to the carrier or force majeure, which would delay or prevent the delivery of the products ordered.
ARTICLE 10 – Pick-Up in Store
The Customer has the option of making a pick-up directly in our store. In this case, the delivery costs do not apply. Pick-Up from the store can be done upon validation of the order and payment (within the limits of available stocks) at the address:
- Monday-Wednesday: 9:30am to 5:00pm
- Thursday: 9:30am to 1:00pm
- Friday: 9:30am to 12:30pm and 1:45pm to 5:00pm
- Saturday: 9:30am to 5:00pm
- Sunday: 9:30am to 1:00pm
The receipt corresponding to the order as well as an ID Card must be presented by the Customer when picking-up in our store.
The package is available to the Customer for thirty (30) calendar days (Monday to Sunday inclusive). The Customer has the possibility to collect the product(s) ordered during this period, but after this period, the fact that the Customer does not collect the product(s) will be perceived by Porte-Bonheur as a systematic refusal by the Customer to accept the delivery. Porte-Bonheur will then be released from its obligation to deliver the ordered items, without being prevented from demanding full payment for the order.
ARTICLE 11 – Product conformity
The Customer or the recipient (trusted third parties receiving the package(s)) will have to sign a Delivery Note acknowledging delivery of the products and is required to check the condition of the packaging as well as the contents of the package.
The Customer therefore undertakes to verify:
- The number of packages received with the number of packages indicated on the carrier’s delivery note;
- The number of product(s);
- The compliance status of the content.
ARTICLE 12 – Returns and Refunds
The Customer may cancel his order within 24 hours following the purchase by notifying Porte-Bonheur of his decision via the Customer Service. For each cancelled order, the Customer will be charged a fee of 5% on the purchase amount.
Returns may be considered upon delivery and subject to the following conditions:
- The product delivered does not meet the customers’ expectations;
- If the Customer notes that the package is not sealed or is damaged at the time of delivery;
- If there is a mismatch between the product ordered and the delivered one.
For the conditions mentioned above, the Customer must not accept the delivery. The Customer is invited to make mention of his disputes directly on the carrier’s delivery note and to contact the Customer Service immediately. The request for exchange or refund, accepted by Porte-Bonheur, will entitle the only reimbursement of the amounts paid. Products opened, damaged or soiled by the Customer will not be refunded or exchanged.
After reception of the goods and verification of their condition, Porte-Bonheur undertakes to reimburse the Customer within seven (7) calendar days (from Monday to Sunday inclusive) following the date of receipt of the return package. Reimbursement will be made with the same method of payment as for the order, except with the Customer’s agreement for another reimbursement method, within the limits of the payment methods available on this website.
Products once sold are not exchangeable and non-refundable.
ARTICLE 13 – Customer Service
For any information or question, Porte-Bonheur Customer Service is available to the Customer:
- Monday-Wednesday: 10:00am to 5:00pm
- Thursday: 10:00am to 1:00pm
- Friday: 10:00am to 12:30pm and 1:45pm to 5:00pm
- Saturday: 10:00am to 5:00pm
- Sunday: 10:00am to 1:00pm
ARTICLE 14 – Marketing
By registering & accepting these Terms and Conditions, you acknowledge and accept to receive promotional advertisement from Porte-Bonheur from time to time.
ARTICLE 15 – Comments
Parts of this website offer an opportunity for Customers to post and exchange opinions and information in certain areas of the website. Porte-Bonheur does not filter, edit, publish or review Comments prior to their presence on the website. Comments do not reflect the views and opinions of Porte-Bonheur, its agents and/or affiliates. Comments reflect the views and opinions of the person who post their views and opinions. To the extent permitted by applicable laws, Porte-Bonheur shall not be liable for the Comments or for any liability, damages or expenses caused and/or suffered as a result of any use of and/or posting of and/or appearance of the Comments on this website.
Porte-Bonheur reserves the right to monitor all Comments and to remove any Comments which can be considered inappropriate, offensive or causes breach of these Terms and Conditions.
ARTICLE 16 – Liability
The products on this website could include technical, typographical, or photographic errors. Porte-Bonheur may make changes to the products on the website at any time without notice. In case of doubt or if you want additional information, please contact the Customer Service.
If these photographs and/or texts were of an erroneous nature, Porte-Bonheur’s liability could not be engaged.
ARTICLE 17 – Possible modifications
Porte-Bonheur may revise these Terms and Conditions at any time without notice. By using this website you are agreeing to be bound by the current version of these Terms and Conditions. It is your responsibility to read these Terms and Conditions each time before using this website.
ARTICLE 18 – Applicable law
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Mauritius. In the event that any dispute arises between you and Porte-Bonheur, the courts of Republic of Mauritius will have sole jurisdiction.
